These terms as they mentioned in the terms and conditions as following:
Customer: the user of the website/application as a buyer or seller.
Website/application: Brandfull website and application.
Account: is the customer’s page that is created to allow him to use
Brandfull for buying and selling.
User: is the owner of the profile and his information is registered on the
account.
First: Account Registration Conditions
(1) You must be over 18 years of age if you use the application within the Kingdom of Saudi Arabia, or have reached the age of majority as stipulated by the laws of the country in which you use the application.
(2) You must register in the (Brandval website/application) in order to be able to benefit from the services of Brandville, and to complete the registration process, you need to fill in the data accurately: write the full name as it appears in your national identity, the current address of your residence, mobile number, e-mail, and any required information as shown on the registration page, - this information will be confidential and will not be viewed by sellers and buyers.
(3) Brandville has the right under the powers granted to it in this Agreement to reject the account creation application and has no justification for the reason for the rejection, and Brandville has the right to cancel or suspend the account at any time whenever it is found that the account owner has written down false and incorrect information or finds in its sole discretion that the account owner has violated or violated any of the Terms of Use.
(4) Brandville has the right to consider the e-mail address, telephone number and any other addresses belonging to the customer as an official means of communication and notice, through which the argument is based on the notification of the customer.
(5) The user is responsible for keeping his account data and must keep his password secure. Brandvale is not responsible for any damages resulting from the user's negligence or negligence in maintaining account and password security.
(6) The user is responsible for all activities and contents uploaded to the site by his account such as data, graphics, images and links (advertising content), and he bears the resulting violation of intellectual property rights or trademarks. The user is also obligated not to upload or transmit any virus or any codes of a destructive nature.
(7) The user is responsible for the correctness and integrity of his data and addresses blogged, and is responsible for the validity and integrity of credit card information and bank accounts that he entered.
(8) A breach or violation of any provision of the Terms of Use leads to the disabling, cancellation or deletion of the user account as Prandville deems appropriate.
(9) The role of Brandville is limited to carrying out the service of mediation, conciliation, bringing the views of the seller and the buyer closer together, and facilitating the task of transporting and delivering the goods, and it does not bear any responsibility resulting from any operation carried out through it.
Second: Buying and Selling Services
(1) When the user wishes to display a commodity for sale, he must accurately describe the commodity according to the advertising/sale form, and the value of the commodity must be specified.
(2) If Brandfull finds that the piece or any part of it does not conform to the specifications and standards of the brand that manufactures it, whether before or after the buyer receives the piece, the piece will be delivered to the concerned authorities by law and compensation for those who prove the right to compensation according to the terms and conditions of the guarantee of originality and reserves the right to refer to the offender with the competent authorities.
(3) If it is proved that the seller used a description in the presentation of the commodity that does not match the reality of the commodity or it is found that the commodity is counterfeit or adulterated, Brandfull has the right to charge the seller the expenses and costs of shipping and the effort expended in the sale, receipt and delivery process, which is estimated at the amount of (228.75)Saudi riyals.
(5) Brandfull reserves the right to provide government agencies with any legal violation committed by the customer, in particular the violations contained in the Anti-Commercial Fraud Law, and Brandfull reserves the right to prosecute anyone who commits a violation of the provisions of this agreement.
(6) When the buyer sends an order to purchase the commodity, Brandfull will deduct the value of the commodity from the Visa/MasterCard or other cards or other payment methods of the buyer, andBrandfull will retain the discounted amount in order to ensure the execution and completion of the sale.
(7) The seller will have one day to issue the approval for the sale by the website including the invoice number and approval of the sale or by sending a text message on mobile number +966592905003 containing the invoice number and approval of the sale, and if the seller does not send the approval within a day, the purchase order will be canceled and the amount returned to the buyer's account, and Brandfull does not bear any costs incurred from the cancellation.
(8) In the event that the seller sends the piece sold without the accessories or one of them, a lump sum or percentage is determined according to the type and value of the accessory to be provided to the buyer directly, and then it is deducted from the seller's dues without referring to the seller and without affecting the Brandfull commission, for the invoice and warranty, 10% of the value of the piece and the rest of the accessories are deducted 50 riyals.
(9) The buyer has the right to cancel the purchase order without entailing costs or fees, in the event that he cancels the order at any time before the product is shipped by the seller, provided that he bears the expenses and bank fees for canceling the order, which are estimated at the amount of (15) fifteen riyals.
(10) The seller is obligated to ship the commodity and send it to Brandfull or deliver it to the representative of the shipping company within 48 hours of accepting the purchase order, and in the event that the seller delays shipping for more than 48 hours, the order will be canceled and the purchase amount returned to the buyer.
(11) Brandfull will retain the amount of the commodity and the buyer must verify the integrity of the commodity and its conformity with the description, in the event that no objection from the buyer arrives within 48 hours of receiving the product, the amount will be paid to the seller after deducting the value of the Brandfull commission, and the buyer is not entitled to claim Brandfull any amount for the sale, except what was in the terms and conditions of the guarantee of originality.
(12) If the buyer submits an objection to the commodity within 48 hours, Brandfull will retain the value of the amount until the validity of the objection is verified, and then the provisions of the guarantee of authenticity contained in this agreement will apply, and Brandfull alone has the right if it proves the validity of what the buyer claims to compensate him with the full amount of the purchase and refer to the seller what it sees.
(13) The seller is not entitled to cancel the order in any case after the shipping company receives his piece or claims to return the piece, and Brandfull will complete the order and transfer the dues to the seller as soon as the order is completed in the absence of objection from the buyer.
(14) Brandfull will receive the commodity from the seller and transfer it to the buyer, and in the event that the purchase order is canceled by the buyer after shipping the commodity from the seller to Brandfull, the buyer will bear the full cost of shipping the product to the seller, which is estimated at (50) fifty riyals.
(15) In the event that the purchase order is canceled by the buyer after shipping the item from Brandfull, he will bear the expenses, shipping costs, and effort expended in the sale, receipt, and delivery process, which is estimated at (228.75) Saudi riyals.
(16) The buyer shall not withdraw from the purchase process after receiving the commodity except in accordance with the provisions of the authenticity guarantee policy mentioned in the provisions of this agreement.
(17) The buyer shall be notified of the date of delivery of the commodity before the completion of the purchase order, and his issuance of the purchase order is his approval of the specified date.
(18) The buyer has the right to cancel the order without incurring any expenses in the event that his receipt of the commodity is more than seven working days late than the specified date, provided that the delay is not due to him such as recording wrong or inaccurate address data or modifying address data after issuing the purchase order.
(19) The seller is not entitled to change the selling price after agreeing to a negotiation process and the buyer paid the amount through the sales platform, and if the selling price was changed from the seller and because of which the sale and return were canceled, the seller must bear the expenses and bank fees to cancel the order, which is estimated at (15) fifteen riyals.
Third: Goods Sold
(1) Through Brandfull, fashion goods such as bags, shoes, accessories, coats, and original wedding items produced by international brands are sold.
(2) Brandfull is prohibited from wholesale, selling cosmetics, electronics, non-new swimwear, and earrings, and in Brandfull it is forbidden to sell non-original products 100%.
(3) It is prohibited in Brandfull to sell materials and goods that are forbidden by Sharia and prohibited by law, and the customer bears full responsibility before the competent authorities when he violates this condition.
Fourth: Payment Services
(1) The customer must write - on the payment page - a valid and valid credit card information (Visa / MasterCard), or the data of any other payment method available on the site or application.
(2) The customer is prohibited from fraudulently using an incorrect or invalid payment method and is also prohibited from using a stolen payment method, and the customer is responsible for violating this paragraph.
(3) Brandfull will deduct the value of purchases from the credit card or payment method approved by the customer by an electronic payment medium.
(4) The issuance of the purchase order by the customer shall be deemed to be an authorization from him that Brandfull is entitled to deduct the value of the purchases.
(5) All purchases are made in Saudi Riyals, and all payments must be in Saudi currency, if the customer pays using another currency, he will bear the expenses and fees resulting from the currency conversion or any other bank fees.
(6) VAT is deducted from the seller's dues after the sale and the completion of the order and is calculated from the value of the commission to the seller, and on the shipping and authenticity services of the buyer.
(7) Brandfull retains the value of purchases and is not transferred to the seller until 48 hours after the buyer receives the products without submitting any objection.
(8) In the event that the buyer submits a complaint on the commodity, the disbursement of the value shall be stopped, the provisions of the refund policy of this agreement shall be followed, and Brandfull shall have the right to withhold the amount until the dispute is settled, and in the event that he does not reach a solution satisfactory to the seller and the buyer, Brandfull shall have the right to deposit the value of the purchases with the treasury of the competent court or with the public treasury at the expense of the parties to the dispute.
(9) The value of the purchases is deposited in the bank account of the seller recorded in his account on Brandfull, and the value of the purchases is refunded to the buyer through his bank account recorded in his account on Brandfull, and the deposit and return period usually takes between 3-5 working days according to the bank's policy, and the transferred customer is charged the cost of any transfer expenses.
(10) The customer grants Brandfull the right to provide Visa, MasterCard or any payment service provider with his credit or bank card details.
(11) Brandfull may request from the customer his personal identification number for the purposes of verifying the authenticity and integrity of the credit card or bank account or verifying the validity of the data of any other payment method.
(12) It is the customer's responsibility to activate any payment method made through his account.
Fifth: Ensuring authenticity
(1) The guarantee of authenticity wherever received means the guarantee provided by Brandfull to the buyer, which guarantees the latter a refund of all purchase amount in the event that it is proven that the purchased piece does not conform to the specifications and standards of the brand of the manufacturer of the piece.
(2) Brandfull alone has the right to ascertain the authenticity of the item to be returned and has sole discretion as to whether the request to return the piece for non-authenticity is valid or not.
(3) In the event that the customer requests to return the piece because it is not authentic, he must first send the piece to Brandfull at his personal expense, and then the piece to be returned is examined by Brandfull to verify the validity of the order, and in the event that Brandfull does not prove the validity of the request, the customer must bear the cost of returning the piece to him and receiving it.
(4) Take the procedure of verifying the authenticity of the piece for a period not exceeding (30) days from the date of receipt of the piece by Brandfull.
(5) The authenticity guarantee does not include any damages or manufacturing and non-manufacturing defects that are in the piece or any part affiliated with it, but the warranty is limited to the conformity of the piece to the specifications and standards of the brand that manufactures it.
(6) The role of Brandfull in this warranty is limited to exerting the necessary care to ensure that the piece conforms to the specifications and standards of the brand that manufactures it, compensating those who have been proven to have the right to compensation and recourse to those who have been proven to have attempted fraud and fraud.
(7) In the event that it is proven to Brandfull that the sold item does not conform to the specifications and standards of the brand that manufactures it, the customer is entitled to a refund of all the purchase amount as recorded in the purchase receipt for the piece.
(8) The customer wishing to submit a request to return the part for not conforming to the specifications and standards of the brand that manufactured it must provide proof of his claim and to Brandfull to refuse to receive the piece in the first place if the customer does not submit proof of his claim before shipping the piece to Brandfull.
(9) In the event that it is proven to Brandfull that the piece to be returned has been tampered with by the customer in any way, this tampering will be taken as a kind of fraud and fraud, and the piece will be delivered immediately to the concerned authorities and the executive of the anti-commercial fraud system, and Brandfull reserves the right to refer to the customer with the competent authorities to claim compensation.
(10) The warranty period is one calendar year starting from the date of shipment of the item to the customer, and the customer is not entitled to request the return of the item after the lapse of the warranty period for any reason.
(11) brandfull has the right to request Documentation and information to complete authentication process and the seller cannot decline or resist due to his agreement to the website terms
(12) Except for what is stated in item (10) for pieces that have an authenticity guarantee card or a certificate of originality for an indefinite period to request the return of the piece due to its non-conformity with the specifications and standards of the brand that manufactures it, provided that the card is available to the customer at the time of submitting the request and all the terms and conditions of the authenticity guarantee apply to him.
SIXTH: Brandfull Rights
(1) Brandfull commission from each sale is 10% of the item amount with an amount not less than 85 Riyal. The commission amount will be deducted from the amount of the item before transfer the seller’s earning.
(2) Brandfull has the right to change or add to the terms and condition at any time without Prior permission from the customer but he will be notified of any change. (3)
Brandfull has the right to hold the returned items until the seller pays any hanging payment as commissions and shipping cost.
(4) Brandfull has the right to provide the authority with the customer's information and log and the customer accept that by accepting the terms and conditions.
SEVENTH: Responsibility
(1) The user acknowledges that he is aware and aware that displaying or selling counterfeit products or tampering with them in any way is considered a violation of the regulations in the Kingdom of Saudi Arabia, and the counterfeit goods and user information will be delivered to the concerned authorities as stipulated in the Anti-Commercial Fraud Law and its executive regulations, and Brandfull reserves the right to refer to the user what it deems necessary to compensate for the damage suffered.
(2) Brandfull's work is limited to carrying out the mediation service and reconciling views - brokerage - between the seller and the buyer, and through its work it is satisfied with what is stated in the guarantee of authenticity and its terms and disclaims its responsibility for what extends beyond the limits of the guarantee of authenticity.
(3) Brandfull is not an agent for the seller and does not commit to its customers the safety of the offered products and is satisfied with what is stated in the guarantee of authenticity.
(4) Neither the seller nor the buyer shall have the right to refer to Brandfull in any form whatsoever, and the lapse of the period referred to above shall be an acknowledgment by the seller and the buyer of their consent and acceptance of the sale, sale and price.
EIGHTH: Logistics
(1) Brandfull will facilitate the shipping by a prior agreement with the shipping company, the seller will ship the sold item with the consigned shipping company and the rules of the shipping apply to both the buyer and the seller according to the shipping company terms and conditions.
(2) the item will be insured during shipping according to the declared value of the item and Brandfull takes no responsibility for any mistake in the determination of the value. The rules of the shipping and insurance agreement will apply to any damages during the shipping.
(3) referring to paragraph (3.11) of the second item and the return policy in this agreement, the buyer will handle the shipping cost with the amount of (50) fifty Saudi riyal for the shipping inside Saudi Arabia and (200) two hundred Saudi riyal for international shipping outside Saudi Arabia.
(4) In the event that the seller chooses to ship the commodity himself and neglects to provide brandville for logistics companies, the seller will cover the shipping value he has chosen, as brandville provides logistical solutions with contracts costing 50 riyals for the two trips.
NINTH: General
(1) official contact with the customer will be through account notification or any other address added to the customer account and it is considered as an argument in informing the client.
(2) The Kingdom of Saudi Arabia law applies to this policy and any conflict against Brandfull Of competence of the authority of the city of Riyadh.
